sell cigarettes at safeway?

Based on the complaint given to Safeway #041 located at 13111 West Alameda Parkway, Lakewood, CO 80228, we could say that they do sell cigarettes.

Safeway #041 was given an FDA Warning Letter Regarding Tobacco Retailer Inspection Violations when a minor was able to buy Camel Crush Menthol cigarettes on July 8, 2016, at approximately 2:27 PM in the establishment.

Owners must comply with federal laws and regulations governing the selling, distributing, and/or advertising cigarettes, cigarette tobacco, and/or smokeless tobacco:

A retailer must NOT sell cigarettes, cigarette tobacco, and/or smokeless tobacco to a person younger than 18 years of age. Doing so violates 21 C.F.R. § 1140.14(a).

The City and County of San Francisco has an ordinance banning tobacco sales at any store that contains a pharmacy. In 2011, the ordinance was challenged by the grocery chain Safeway, Inc., which argued grocery stores with pharmacies had a constitutional right to sell cigarettes.

The lawsuit was dismissed by California Federal Court. The City and County of San Francisco first enacted this ordinance in August 2008, which barred pharmacies from selling tobacco products. But this ordinance explicitly exempted big-box and grocery stores from the ordinance.

In 2014, attorneys general from across the nation asked the country's top retailing names to quit selling tobacco product following CVS Caremark's (NYSE: CVS) decision to end all tobacco sales in its stores.

Letters were sent to Walgreen (NYSE: WAG), Rite-Aid (NYSE: RAD), Wal-Mart (NYSE: WMT), Kroger (NYSE: KR), and Safeway (NYSE: SWY) from the prosecutors urging them to stop selling tobacco.
